Increase in Indian Patent Office Fees


NEW DELHI - According to a public notice on the Indian Patent Office's website, the Ministry of Commerce and Industry in India recently published Patents (Amendment) Rules 2014 which have come into effect on February 28, 2014.

The said Rules are available on the website of Office of Controller General of Patents, Designs and Trademarks:

The amendments are summarized as follows:

1- Introduce a new entity “Small Entity”:
a) in case of an enterprise engaged in the manufacture or production of goods, an enterprise where the investment in plant and machinery does not exceed INR10 million ($1,626,016); and
b) in case of an enterprise engaged in rendering services, an enterprise where the investment in equipment does not exceed INR5 million ($813,008).

2- Introduce a new form 28, to be submitted by the Small Entity, and has to accompany every new application.
3- E-filing fee is 10% less than paper filing.
4- Provide a new form 7 (A) for filing representation for opposition pre grant. Earlier, opposition was applied in a white paper only.

It is worth noting that the Government of India has increased the official fees for filing patent applications at the Indian Patent Office. Consequently, AGIP charges for India will be amended to reflect this increase.
