FAQ


Non-traditional trademarks (e.g., smell marks, sound marks, etc.) are not protected in Iran. 


A Trademark consisting of a geographical indication or a national symbol, whether consistent with the applicant’s nationality or not, cannot be registered in Iran.


A slogan can be introduced as a wordmark in Iran, noting that all the criteria for a trademark application will be implemented. 


According to Iran Intellectual Property regulations, proof of use is not required to maintain the registration of a Trademark. However, any third party can file a cancelation suit against a Trademark registration that has not been used for three consecutive years. It is worth mentioning that any kind of usage of a Trademark can be presented as proof of use, and prevent the mark from being subject to non-use cancellation.


According to Iran Intellectual Property regulations, any form of utilization of a Trademark is considered as ‘use’. Aside from the practical use of a Trademark in the market, publications such as pamphlets, brochures, etc. are also counted as use.


- To be Creative and innovative
-To have distinctive element(s)
-Not similar to the prior protected Trademarks
-To be easily pronounced  
-Not having deceptive elements (e.g. geographical indications, etc.)
-Meeting moral order and Sharia Law


The TM symbol placed next to a mark is meant to notify the public that the owner considers that particular Trademark to be proprietary. In other words, the owner is claiming rights to that Trademark, even in the case, the trademark application has not been filed.
The symbol ® indicates the Registration of a Trademark and is to notify the public that the Trademark is legally protected. Using this symbol gives a trademark proprietor better protection in court, noting that no infringer can claim unawareness so long as the registration symbol is used in accordance with the law.
