Keep in mind, that a distinctive word or words have no direct reference to the character or quality of the goods and do not be according to their ordinary signification, geographical name, or surname.

a.Deceptive or Scandalous marks: It is unlawful to register as a trademark or part of any trademark, any matter the use of which would, by reason of its beings likely to deceive or cause confusion or otherwise, be disentitled to protect in a court of justice or be contrary to law or morality or any scandalous designs.
b.Identical and Resembling Trademarks: No trademark can be registered in respect of any goods or description of goods in respect of any goods or description of goods that is identical with a trademark belonging to a different proprietor and already on the register in respect of the same goods or description of goods or that so nearly resembles such a trademark as to be likely to deceive or cause confusion.
c.Names of chemical substances: The Act contains a restriction on registration relating to the names of chemical substances. Accordingly, “no word which is the commonly used and accepted name of any single chemical element or single chemical compound, as distinguished from a mixture, is to be registered as a trademark in respect of a chemical substance or preparation”.
