Registration in Kenya is not mandatory. But should one file with the Kenya Copyright Board, it takes approximately, 5 working days from the date of registration.


The Kenya Copyright Board maintains a register of all works registered under the Copyright Act. Subject to making the requisite application and on the terms set by the Board, members of the public can search for works that have been copyrighted.


Essays and articles form part of literary works which are eligible for copyright protection.


The use of copyrighted works without the license of the owner translates to infringement and the owner may bring an action for infringement and be eligible for the reliefs set out in the Copyright Act.

Royalty-free pictures available on the internet can certainly be used in marketing materials. Quotes enjoy protection as literary works and cannot be used without the consent of the author unless the work has fallen into the public domain.


Literary works are eligible for copyright so long as sufficient effort has been expended on making the work to give it an original character and the work has been written down, recorded, or otherwise reduced to material form.
