Industrial drawings only protect the appearance, pattern, and color. Industrial models protect the structure of an invention.


The pattern of a design may be protected as a copyright.


1. Buildings, bridges, and other products that cannot be assembled in the factory, such as houses, museums, etc... However, this restriction does not apply to building components, such as doors, windows, and small movable houses, which can be mass-produced in the factory.
2. Objects without fixed shape, such as gas, liquid, or flowing substances, as well as powder and granular aggregates.
3. Parts of the product that cannot be sold and used separately, such as knife handle, the handle of water cup, etc.
4. Objects that cannot be used for vision or are difficult to judge with the naked eye.
5. Not a protective design is required by the shape of the piece itself.
6. Products that take natural objects as the main body of appearance design and cannot be mass-produced.
7. Works that are purely within the scope of art, such as painting and sculpture, shall not be protected by design patents.
8. A design based on common shapes and patterns that people with general knowledge or skills in the technical field think is very easy to create.
9. Imitate the designs and images of famous works, buildings, and portraits, and use them intact on patented products.
10. National flag, national emblem, trademark, and other signs.


Design is easier to register since there is only a formality examination. 3D marks usually will be rejected by similar marks as well as lack of distinctiveness.
