Requirements

1- Patent application under Paris Convention:

Required Documents:

-A Power of Attorney to be legalized up to the Syrian consulate. Subsequent local super-legalization procedures of the POA in Syria take 1-2 months. 
Alternatively, it is possible to prepare a POA to our Lebanon Office -legalized by a Lebanese Embassy- authorizing them to issue a sub-POA to our Syria Office. 

-A priority document (certified copy of the application that priority is to be claimed in Syria), which can be filed within (3) months from the date of filing the application in Syria.

-Specifications, claims and abstract of the invention in English or French with the Arabic translation, which can be made through our office. 

-Legalized assignment from the inventor(s) to the applicant, in case the priority application was filed in the name of the inventor(s), which can be filed within (3) months from the date of filing the application in Syria.

-At a later stage and in order to support the consideration procedures by the PTO, a certified copy of the corresponding letters patent issued in the home country of the applicant or any other foreign one is required. 

2- National Phase Entry of PCT:

It is possible to file a national application of PCT international application in Syria by the 31-month period. 

Required Documents:

-A Power of Attorney to be legalized up to the Syrian consulate. Subsequent local super-legalization procedures of the POA in Syria take 2-3 months. 

-A copy of the PCT international application (request form 101).

-WIPO IB advice of the priority document transmittal (form 304).

-A copy of the PCT publication.

-A copy of the search report and the ISA's written opinion.

-A copy of the Preliminary examination report.

-Specifications, claims and abstract of the invention in English or French with the Arabic translation, which can be made through our office. 

Notes:

  • Pharmaceuticals and chemical compounds are not patentable under the Syrian Patent Law substantially. However, such inventions are filed as to the method of preparation thereof, whereupon the invention title and the claims should be amended to start with "Method of preparation of …."
  • The PCT supportive documents should be translated into Arabic by local sworn translator and authenticated in Syria.
  • A 3-month grace period is allowed for late payment of annuities against payment of a lateness fine.
  • The Arabic version of patent specifications exceeding the first (30) pages and the claims exceeding the first (10) claims will be surcharged individually per page/claim.
  • The annuities from the international filing date to the filing year should be paid upon filing the application for the PCT applications.
  • If accepted, first publication of the accepted patent application for opposition occurs for six months.
  • If granted, second publication of registered patent certificate and registration fees of a patent should be paid to be followed by receiving the Patent Certificate.
  • Annuities should be paid annually from the international filing date for patent application under PCT and as from the national filing date for patent application under Paris Convention.
  • Patent duration in Syria is (20) years as from the international filing date for patent application under PCT and as from the national filing date for patent application under Paris Convention.
  • Working of a granted patent is compulsory within 3 years as of the date of the grant. In the absence of local investment, a nominal working notice published in a local newspaper inviting potential investors to exploit the invention in the country is acceptable for satisfying the compulsory condition.
