Filing Requirements
Trademark/Service Mark/Collective Mark Applications
1. Anoriginal Power of Attorney duly notarized and signed by the trademark owner,and legalized by the Libyan Consulate in the applicant’s home country.
2. An original certificate of incorporation, or original extract from the Commercial Register legalized by the Libyan Consulate.
3. A certified original of the priority document legalized by the Libyan Consulate, if claimed.
4. A copy of the passport or ID of the person authorized to sign the Power of Attorney.
5. A pledge from the owner of the mark that the goods conform to Libyan specifications and standards.
6. A picture of the product or products of the trademark.
7. Product name.
8. An Arabic translation is required for a mark that comprises non-Arabic characters.
9. A sound mark should be represented by submitting an audio file reproducing the sound.
10.Translation of all documents (legal power of attorney and commercial register) into Arabic.
11.It is necessary to mention the date of signing the power of attorney.
12.Translating the name of the applicant for filing the mark verbally into Arabic (if possible)
Special note: fees for filing each trademark will be paid with one financial receipt, ex. (1 trademark with 1 financial receipt). This procedure applies to all other trademark services (renewal, etc.)
Time Frame
• A trademark registration is valid for ten years from the date of filing the trademark application.
The following documents and information are required for filing a trademark application in Libya with claiming priority :
Special note: we kindly ask you to send us the instructions before five days from the priority deadline.
•Simply signed Power of Attorney, after filing the trademark the original legalized copy must follow after one month by return courier.
•Copy from the Commercial Extract, after filing the trademark the original legalized copy must follow after one month by return courier.
•Certified priority document along with certified Arabic Translation, after filing the trademark the original certified copy must follow after one month by return courier.
All above mentioned documents must be submitted along with Certified Arabic Translation.
Merger/ Assignment Requirements:
•Power of Attorney in the new name duly legalized up to Libyan consulate
•Document proving the change duly legalized up to Libyan consulate such as deed of assignment or merger document.
•Certificate of incorporation or extract from commercial registry for the new entity duly legalized up to Libyan consulate
All documents must be legalized up to Libyan consulate and submitted along with its certified Arabic translation
Change of Name/Address Requirements:
•Power of Attorney in the new name or address duly legalized up to Libyan consulate
•Document proving the change duly legalized up to Libyan consulate.
•Certificate of incorporation or extract from commercial registry for the new legal entity duly legalized up to Libyan consulate
All documents must be submitted along with its certified Arabic translation .
