Agreement with Austria

In a major step towards developing and effecting the patent system in the United Arab Emirates, UAE’s Ministry of Finance and Industry has signed an agreement with the Austrian Patent Office for the examination of Patent Applications filed in the UAE. As the UAE Patent Office has not yet started examination of Patent Applications filed since 1994, no patents have been granted ever since. The UAE Patent Office has now decided to seize the opportunity and employ Austrian expertise and examination committees to examine the pending applications in the UAE and proceed with the same upto registration.

There has also been an IP-coordination agreement between both the UAE and Austrian Patent Offices, allowing the exchange of expertise between the two offices. UAE Officials are to receive the necessary training in the Austrian Patent Office, and the UAE Patent Office will be hosting experts from the Austrian Patent Office to help out in developing the work in the Industrial Property Department.

Mr. Mohammed Ali Zayed, Assistant Deputy for Industrial Affairs, has called upon all patent agents and owners of UAE patent applications to complete their files in compliance with the present UAE Patent Law. He confirmed that the Ministry will coordinate with the General Post Office for sending and receiving Patent specifications to Austria for examination.

The UAE Patent Office is therefore required to conduct a search for all the priority patent applications which contain a novelty search. In case of the absence of novelty search in the priority-based applications, a search by the UAE Patent Office will be conducted to determine the novelty of the application. This will also include the patent application itself depending on the search report conducted by the Austrian or any other patent office.

Mr. Zayed also added that the novelty search reports issued by the Austrian and the American Patent Offices are going to be acceptable to the UAE Patent Office.There is going to be an interactive exchange of IP information and data with the Austrian Patent Office through the web. Mr. Mohammed Ali Bin Zayed, Assistant Deputy for Industrial Affairs, signed the coordination and understanding agreement on behalf of the UAE Ministry of Finance and Industry, and Mr. Autmer Ravin, Head of the Office, signed for the Austrian Patent Office.
