AGIP India Defeats Patent Pre-grant Opposition for Anti-cancer Compound

NEW DELHI - While defending its client Seattle Genetics, Inc., our patent team in India office has succeeded in defeating a patent pre-grant opposition, which was filed by an Indian Pharmaceutical Alliance for anti-cancer compound. 

“These are exciting times for India as its IP landscape is evolving. Sometimes the oppositions are filed just to delay the prosecution. Each opposition has to be handled with a different outlook. Using our patent resources worldwide, we always tailor a strategy to customize our clients’ needs”, said Mr. Rohit Singh, Head of Patents Department in India office, who had represented the client before the Indian Patent Office.

In India, an opposition can be filed before or after the grant of a patent. Any person can file a pre-grant opposition, however, only a person involved in similar business as that of the applicant can file a post-grant opposition.
